Please read these Terms carefully. By creating an account or using Bike Trip Planner, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Pixels Technologies ("Company", "we", "us") governing your access to and use of the Bike Trip Planner application and associated services (collectively, the "Service").
By downloading the app, creating an account, or otherwise accessing the Service, you confirm that:
- You are at least 13 years of age (or 16 in certain jurisdictions).
- If you are under 18, you have received parental or guardian consent.
- You have the legal capacity to enter into a binding agreement.
- You agree to comply with all applicable local, state, national and international laws.
Service Description
Bike Trip Planner provides the following features:
- Route planning, discovery, and saving with difficulty ratings and terrain information.
- Group trip organisation, participant management, and invite link generation.
- Real-time GPS tracking and live location sharing during active trips.
- Emergency SOS alert broadcasting to designated contacts and trip members.
- Ride statistics, performance analytics, and personal records.
- Community route sharing and discovery.
We reserve the right to modify, suspend or discontinue any feature of the Service at any time with reasonable notice where practicable.
User Accounts
3.1 Registration
You must provide accurate, current, and complete information during registration and update it as needed. You may not impersonate another person or use a false identity.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to immediately notify us of any unauthorised access at security@pixelstechnologies.com.
3.3 One Account Per Person
Each person may maintain only one active account. Creating multiple accounts to evade restrictions is prohibited.
Acceptable Use Policy
🚫 Violations of this policy may result in immediate account suspension or permanent termination.
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Transmit unsolicited commercial messages or harass other users.
- Post false or misleading route information that could endanger other riders.
- Abuse the SOS feature by triggering false emergency alerts.
- Reverse engineer, decompile, or attempt to extract the source code of the app.
- Access the Service through automated means (bots, scrapers) without prior written permission.
- Attempt to gain unauthorised access to other users' accounts or our backend systems.
Safety & SOS Feature
"The SOS feature is provided as an emergency assistance tool. It is not a substitute for contacting local emergency services (911, 112, or your national emergency number)."
5.1 SOS Alerts
- Your current GPS coordinates are broadcast to your designated emergency contacts and active trip members.
- You should simultaneously contact official emergency services if your situation requires it.
5.2 SOS Limitations
- The SOS feature requires an active internet connection. It will not work in areas without cellular data or Wi-Fi coverage.
- We do not guarantee delivery of SOS alerts in all circumstances.
- Pixels Technologies is not a professional emergency response service and accepts no liability for SOS delivery failures.
5.3 Cycling Safety
Cycling carries inherent physical risks. You are solely responsible for your safety on every ride. Always obey traffic laws and use appropriate protective equipment.
User Content
By submitting content (route data, trip descriptions, profile information, photos) to the Service, you retain ownership but grant Pixels Technologies a worldwide, royalty-free licence to host, display and distribute your content for the purpose of operating and improving the Service.
User Content must not: be false or misleading, contain hate speech or illegal material, or infringe third-party intellectual property rights.
Intellectual Property
The Service and all content, software, design, trademarks and technology comprising it are owned by or licensed to Pixels Technologies. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.
You may not copy, modify, distribute, sell or create derivative works from any Company Content without our express prior written consent.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Third-Party Services
The Service may integrate with third-party services (Google Maps, Google Sign-In, Apple Sign-In). These services are governed by their own terms and privacy policies. We are not responsible for the practices of any third-party service provider.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
- The Service will not be uninterrupted, error-free or secure.
- Route information may not be accurate, complete or current.
- GPS location data may not be precise in all environments.
⚠️ Outdoor activities carry inherent risks. You assume all risk from participation in cycling or any outdoor activity facilitated through this Service.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIXELS TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Our total aggregate liability to you for any claim shall not exceed INR 1,000 or the amount you paid to us in the 12 months preceding the claim, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Pixels Technologies, its affiliates, officers, employees and agents from and against any claim, liability, damage, loss and expense arising out of your violation of these Terms, your User Content, or your negligence during any ride organised via the Service.
Termination
You may close your account at any time via Profile → Settings → Delete Account. We may suspend or terminate your access if you violate these Terms, if required by law, or if we reasonably believe your account poses a security risk.
Dispute Resolution
Before pursuing any formal dispute, please contact us at legal@pixelstechnologies.com to attempt informal resolution. If unsuccessful, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India) in Bangalore, Karnataka, India.
Governing Law
These Terms shall be governed by the laws of India, without regard to conflict of law principles. The courts of Bangalore, Karnataka, India shall have exclusive jurisdiction over disputes not resolved by arbitration.
Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated by updating this page, sending an in-app notification, and emailing you for significant changes. Continued use after the effective date constitutes acceptance.
